What is the difference between leasehold and freehold in Thailand?

Short answer: In Thailand, leasehold and freehold are two very different types of property ownership, especially relevant for foreigners buying property in Pattaya or elsewhere. Freehold Ownership. Freehold means you own the property outright, including the land (in the case of a house) or the condo unit (if it’s in a registered condominium).
In Thailand, leasehold and freehold are two very different types of property ownership, especially relevant for foreigners buying property in Pattaya or elsewhere.

Freehold Ownership

Freehold means you own the property outright, including the land (in the case of a house) or the condo unit (if it’s in a registered condominium). For foreigners, the most common form of freehold ownership is via a condominium unit, as foreigners can legally own up to 49% of the total floor area of a condo building. Key benefits of freehold:
  • Full ownership with your name on the title deed (Chanote).
  • You can sell, transfer, or pass on the property as you wish.
  • More attractive for long-term investment.

Leasehold Ownership

Leasehold means you’re leasing the property for a fixed period, typically up to 30 years (renewable by agreement). This is common for villas or houses where foreigners can't legally own land. Key points about leasehold:
  • You have legal rights as a tenant under Thai law.
  • Often used for luxury villas or developments offering renewable lease terms (e.g., 30+30+30 years).
  • You don’t own the land, just the right to use it for the lease term.

Which is better?

It depends on your long-term plans. If you're looking for full ownership and more security, freehold (especially for condos) is usually the preferred option. If you're investing in a villa or want a house close to the beach in Pattaya, leasehold can still be a smart choice if structured properly. 👉 At Alan Bolton Property Consultants, we help clients understand these legal structures and choose the best fit based on their goals.
